1. Buy Hoosier is a directory
Buy Hoosier helps people find Indiana farms that sell straight to customers, and gives each listed farm a page of its own (a “Farm Stand”). Listing is free.
The farms are the sellers. Buy Hoosier does not make, sell, store, inspect or deliver any product, and is not a party to any sale. When you buy from a farm, the agreement is between you and the farm.
Each farm is solely responsible for its products, including their safety, handling, labeling, licensing, permits, inspections and legality, and for its prices, hours and what it says about its products and practices.
2. For customers
- Farms are independent businesses. We don't inspect farms or their products, and a listing is not an endorsement.
- Information can change. Farms update their own pages, and some pages were started from public information. Hours, prices and availability may be out of date. Call the farm before you make a trip.
- Questions about a product, an order or a refund go to the farm.
3. For farms
Who can list. Buy Hoosier is for farms and makers in Indiana that raise or make their own products and sell them directly to customers. We decide who is listed and may decline or remove a listing.
Your account. Keep access to your email secure; sign-in links go there. You are responsible for what the people you add to your farm's team do on your page.
Your content. You own what you put on your Farm Stand: text, photos, prices and posts. You give Buy Hoosier permission to show it on the site, in search results, in share previews and in Buy Hoosier's own promotion of the directory (for example, a newsletter pointing to your page), for as long as your page is listed and a reasonable time after. You confirm you have the right to post it, including permission from anyone who can be recognized in your photos.
Your products and your page. You are responsible for making sure everything you sell, and everything your page says, follows the law, including food safety, labeling, licensing and inspection rules. Don't post anything false or misleading about your products or practices, products you are not allowed to sell, other people's photos or writing without permission, or anything hateful, harassing or unrelated to your farm.
The writing helpers. “Set it up for me” and “Improve this” suggest text from what you tell them. You decide what to publish, and you are responsible for what your page says. Check every fact.
Messages. If your page has a message form, customers' messages come to your email with their address to reply to. Buy Hoosier keeps a copy and limits how many can be sent.
Pages we started. Some pages were built from public information before the farm joined. The farm can claim its page for free, or ask us to correct or remove it at brett@buyhoosier.com.
Leaving. You can ask us to take your page down at any time.
4. Products we don't list
We don't list products that can't lawfully be sold to consumers in Indiana. Raw milk and herd-share products are not shown on public pages.
5. Using the site
Don't misuse the site: no scraping in bulk, no attempts to break in or overload it, no fake applications or claims, no pretending to be someone else, and no sales pitches, spam or harassment through a farm's message form. We may suspend accounts or remove content that breaks these terms.
6. No warranty
The site is provided as it is. We work to keep information accurate but don't promise it is complete, current or error-free.
7. Limit of liability
To the fullest extent the law allows, Buy Hoosier and Indian Lakes Marketing LLC are not liable for any loss arising from a purchase you make from a farm, from a farm's products, or from relying on information on the site, and are not liable for indirect, incidental or consequential losses. Where liability can't be excluded, it is limited to $100.
8. Paid features later
Listing is free. If Buy Hoosier adds paid features (for example, Premium pages or online orders with a fee), they will come with their own terms, and we will say so plainly before anyone is charged.
9. Changes
We may update these terms. We'll post the new version here with a new date. If a change is significant, we'll also email farms that have accounts.
10. Law
These terms are governed by the laws of the State of Indiana, and any dispute will be heard in the state or federal courts located in Indiana.
